No Purchase or Play Necessary to Enter or Win.
Notice Regarding Dispute Resolution: These Official Rules contain provisions that govern how claims you and we may have against each other are resolved (see Rule 7 below), including an agreement and obligation to arbitrate disputes, which will, subject to limited exceptions, require you to submit claims you have against us to binding arbitration, unless you opt-out in accordance with Rule 7.
1. Eligibility: The above-named sweepstakes (“Sweepstakes”) is open to legal residents of Louisiana who are twenty-one (21) years of age or older. Employees, officers, directors, agents, and representatives of American Wagering, Inc. dba Caesars Sportsbook (“Caesars Sportsbook” or “Sponsor”), New Orleans Pelicans NBA, LLC (“Pelicans”), the NBA Entities (as defined below), teamDigital Promotions, Inc. (“Administrator”), and each of their respective parents, affiliates, subsidiaries, agents, wholesalers, retailers, distributors, suppliers, advertising, and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (spouse, parents, legal guardians, in-laws, grandparents, grandchildren, siblings, and children, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void outside of Louisiana, and where prohibited by law. All applicable federal, state, and local laws apply. The National Basketball Association (“NBA”) and its member teams (excluding Sponsor), NBA Properties, Inc., and NBA Media Ventures, LLC (collectively the “NBA Entities”) are neither a sponsor nor affiliated with this Sweepstakes and are not responsible for the promotion, administration, or execution of this Sweepstakes.
2. Promotion Period: Sweepstakes begins 12:00:00am Central Time (“CT”) on 8/20/23 and ends 11:59:59pm CT on 12/9/23 or when the Pelicans are eliminated from the Tournament as described below, whichever comes first (hereafter, “Promotion Period”).
3. How to Enter: There are multiple ways to participate during the Promotion Period, as described below:
i) In-Season Tournament Attendance: Participants who purchase or legally obtain at least one (1) mobile ticket and attend one (1) game of either the Group Play or the Quarterfinals portion of the NBA In-Season Tournament (“Tournament”) at the Smoothie King Center in New Orleans, LA will automatically receive a total of one thousand (1,000) entries per game attended. In the event the Pelicans host a home game in the Quarterfinals portion of the Tournament, participants who attend all three (3) home Tournament games at the Smoothie King Center in New Orleans, LA will receive a total of five thousand (5,000) entries. Group Play games will take place at the Smoothie King Center in New Orleans, LA on 11/14/23 and 11/17/23, respectively. If the Pelicans host a Quarterfinals game, that game would take place on either 12/4/23 or 12/5/23, as determined by the NBA. In order to be entered, eligible participants entering by this method must scan their ticket upon entry of the Smoothie King Center during Tournament games only.
ii) Opt In and Wager Using Caesars Sportsbook:
a. Opt-In Entries: While on the Caesars Sportsbook mobile app or website in Louisiana, registered users can click on the tile/link for this Sweepstakes on the “Promos” page (https://www.caesars.com/sportsbook-and-casino/la/promos/) and follow the instructions to opt in to participate in the Sweepstakes. Participants who opt in during the Promotion Period will receive one (1) Sweepstakes entry.
i. If you are not already registered for a Caesars Sportsbook account in Louisiana, you may sign up for one when you visit https://www.caesars.com/sportsbook-and-casino/la/, or you may register through the Caesars Sportsbook mobile app on your mobile device.
ii. If you do not already have the Caesars Sportsbook mobile app on your device, you can visit the App Store or Google Play Store and download the app (message and data rates may apply for app download and use) for free.
b. Qualifying Wager Entries: Once opted-in, participants can receive fifty (50) additional entries for every qualifying sports wager (see below) placed during the Promotion Period on the Caesars Sportsbook app or website in Louisiana.
i. To qualify, your wager must be at least $10, have minimum odds of -300, and settle before the end of the Promotion Period. As an example, a $10 wager with odds of -250 or +100 would qualify, but a $10 wager with odds of -500 would not.
ii. The following wagers will not qualify for entries in this Sweepstakes:
1. Wagers placed before opting in to participate in the Sweepstakes;
2. Wagers settled before normal market settlement via the “Cash Out” feature; or
3. Wagers placed on Caesars Sportsbook services outside of Louisiana.
c. Additional Entries for Live Wagers: In the event your qualifying wager is also a “live” wager placed on and during any Pelicans home game during Group Play, you will receive fifty (50) additional entries. As an example, if you place a qualifying wager (i.e., wager is $10+ with -300 odds or longer) on the “Next Basket Scorer” during the New Orleans vs. Dallas Tournament game on 11/14/23, you will receive one hundred (100) entries in total—fifty (50) entries for the qualifying wager and an additional fifty (50) entries because your wager was a “live” in-game wager placed during a Pelicans home game during Group Play.
iii) Mail-in: To receive two hundred fifty (250) additional entries without purchasing a ticket to attend the Tournament, opting in, or placing an eligible wager, hand-print your full name, street address, city, state, zip code, day and evening telephone numbers (including area codes), date of birth, email address (optional), the name of Sweepstakes (“Pelicans Win, You Win”) on a 3”x5” piece of paper and mail such paper in a sealed envelope with proper postage affixed to: Caesars Sportsbook and Casino, 6385 S Rainbow Blvd #100, Las Vegas, NV 89118. Attn: Pelicans Win, You Win mail-in entry.” Incomplete and/or inaccurate entries are void. Sponsor will use email addresses provided via mail-ins for prize notification purposes only. Mail-in entries must be postmarked by the close of the Promotion Period and received by Sponsor by December 15, 2023 to be eligible.
All entries become the exclusive property of the Sponsor and will not be acknowledged or returned. Paper or non-mobile game tickets not associated with a season ticket account are not eligible for entry. The season ticket account holder associated with a paper or non-mobile game ticket will be considered the entrant regardless of the individual possessing the paper or non-mobile ticket. Complimentary tickets are not for entry into the Sweepstakes. The use of script, macro, or automated devices (or any other devices intended to automate or subvert any aspect of entry) to enter the Sweepstakes is prohibited and any entry through such means and any entry that is deemed to be ineligible (at Sponsor’s sole discretion and in accordance with these Official Rules) are void. In the event of dispute as to the identity of any potential winner, the winning entry will be declared made by the Authorized Account Holder of the email address associated with entry, provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is the natural person to whom the applicable ISP (as defined below) or other organization (such as a business or educational institution) has assigned the submitted email address for the domain associated with such email address.
Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, postage-due, garbled, inaccurate, or undelivered entries or mail, or for telephonic, human or computer failures, problems, or errors, interruptions in service due to system upgrades, repairs, modifications, or other causes, failures, or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines, or telephone systems, traffic congestion on the internet, technical, or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error, or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of registration forms, entries, or the announcement of any prize; or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes, or for printing, typographical, human, or other errors appearing in these Official Rules or other Sweepstakes-related materials. Sponsor reserves the right, in its sole discretion, to void any entries of participants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes or is in violation of these Official Rules.
All information submitted by participants to Sponsor is subject to Sponsor’s Privacy Policy accessible at https://www.caesars.com/corporate/privacy. By entering this Sweepstakes, participants give their express permission to be contacted by Sponsor and/or Administrator by telephone and/or e-mail for Sweepstakes purposes. All information submitted by participants to the Pelicans is subject to the Pelican’s Privacy Policy accessible at http://www.nba.com/news/privacy_policy.html.
4. Winner Selection/Notification: In the event that the Pelicans win the Tournament (the “Event”), one hundred (100) Grand Prize winners will be randomly selected on or about 12/16/23 (“Prize Drawing”). The Prize Drawing (if any) will be conducted by Administrator, an independent sweepstakes management company. Subject to verification of eligibility and compliance with these Official Rules, the potential Grand Prize winners will be declared the official Grand Prize winners of the Sweepstakes. In the event that the Event does not occur, no prizes will be awarded. The decisions of Sponsor will be final and binding in all matters relating to this Sweepstakes. Potential Grand Prize winners will be notified by e-mail and will be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, Administrator is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s and Administrator’s discretion, an alternate winner may be selected/notified. Odds of winning depend upon the total number of eligible entries received and if the Event occurs. Limit one (1) prize per person per household.
5. Maximum of one hundred (100) Grand Prizes: If the Event occurs, each Grand Prize winner will receive $10,000 in the form of a check. Approximate Retail Value (“ARV”) = $10,000 each. All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including, but not limited to, all federal, state, and local taxes are winner’s sole responsibility. Total ARV of all prizes (if awarded): $1,000,000.
6. Miscellaneous: No transfer, assignment, cash redemption, or substitution of any prize (or portion thereof) is permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value, at its sole discretion. Participants agree, by entering, that (1) Sponsor and its designees may use (unless prohibited by law), participant’s name, city and state of residence, photograph, any recording (voice, film or video), and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, (2) Sponsor reserves the right to conduct a background check and entry in the Sweepstakes constitutes participant’s permission for Sponsor to conduct such background check, provided that, to the extent additional authorization is necessary under law, participants shall authorize such check. Sponsor reserves the right (at its sole discretion) to disqualify any participant based on the results of the background check or failure of the participant to properly authorize such check, and (3) the Released Parties shall have no liability and will be held harmless by participant for any claim, action, liability, loss, injury or damage to participant or any other person or entity, including, without limitation, personal injury or death to participant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize and any travel or travel-related activity thereto (including, but not limited to, attendance at any game) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes (or portion thereof) for any reason, including should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in the case of termination, at its discretion, select the winner at hand from eligible non-suspect entries received prior to the event that required such termination. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek any and all remedies available from any such person(s) responsible for the attempt to the fullest extent permitted by law.
7. Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Sponsor (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. Notwithstanding the parties’ agreement to resolve all disputes through arbitration, you can opt out and not be bound by the arbitration and class action waiver provisions set forth above by sending written notice of your decision to opt out to ArbitrationOptOut@caesars.com. The notice must include the Sweepstakes name and be sent within thirty (30) days of your first entry in the Sweepstakes, otherwise you shall be bound to arbitrate disputes in accordance with the terms of these Official Rules. If you opt-out of these arbitration provisions, Sponsor also will not be bound by them.
8. Choice of Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Louisiana, USA, without regard to its conflict of laws principles.
